I meant this as two questions. In one case you’re drunk but the horse is sober. In another case you’re sober but the horse is drunk. Are both cases drunk driving?

The argument was presented when I was told that a drunk driver and a drunk passenger can receive the same sentencing but I disagree because the driver is charged with a DUI which is a far more serious charge while the passenger cannot receive a charge of DUI thus the sentencing for the DUI would be more harsh.

Also, if the drunk driver is convicted and in prison and the victim, still alive at the time of sentencing with serious injuries such as paralysis, dies later because of injuries related to the accident, could that in any way change the driver’s sentence?

If an alleged drunk driver runs into a Police Officer (on or off duty) is that considered an assault on an officer?

I recently found out that my father was involved in a drunk driving accident in the 1970s in which he was the driver, that resulted in the death of his fiancee. I know my father is a recovered alcoholic but this was news to me, and I don’t want to press him on it. Is there any way to find information about such an accident online? The Omaha-World Herald doesn’t seem to keep records dating back that far. I don’t think he was charged in the accident so I don’t think he has a criminal record either.
