Can you be charged in a drunk driving accident if you are not driving?

So say and your buddy decide to go for a drive and your both drunk. Your friend is driving and hits someone. Can you be charged in the accident even though you were not the one behind the wheel?
What if it was his car?

    Yes, you can be charged for allowing a drunk or unlicensed driver to drive your car.

    Unless you distracted the driver in some way or contributed to the accident I dont think so.

    No, I know someone that was driving drunk and he got the DUI and his passenger went home because he was not driving so there was no violation to the law.

    In some states if you knowingly let a drunk person drive your car, you can get in trouble too. If it his car you can’t be charged with drunk driving, but they might give you a drunk in public fine if you are obviously intoxicated.

    You have to be operating a motor vehicle to get a DUI. You really got a driving under the influence in the passenger’s seat? LOL. That’s a new one for me. keep me posted on the outcome of that one please!
